General terms and conditions : 


A relationship of mutual trust between POP POT SRL and its clients is our priority. To ensure that our services are provided under the best possible conditions for both parties, please find below our general terms and conditions. POP POT SRL is registered at Rue Berthelot 106–108, Box 6, 1190 Forest, and with the Crossroads Bank for Enterprises under company number 0711.776.102.

POP POT SRL acts as a catering and service provider for private and corporate events. 

1. General

These general terms and conditions apply to all services provided by POP POT SRL. They constitute the contract binding the parties, to the exclusion of any conditions of the client. The non-enforcement of any clause of these general terms and conditions shall not be interpreted as a waiver of POP POT SRL’s right to enforce such clause in the future. 

2. Price and taxes

All prices are expressed in euros (EUR) and are subject to VAT (12% on food; 21% on drinks, services, delivery, and equipment).

In the case of delivery only (no equipment, no waitering), prices are subject to VAT as follows: 6% on food and soft drinks, and 21% on alcoholic drinks and delivery.

3. Offer

Offers issued by POP POT SRL are made without obligation. 

4. Validity of the offer

In all circumstances, the prices stated in the offer shall no longer be valid if the offer has not been signed by the client and returned to POP POT SRL by email at info@pop-pot.com.

5. Revision

The offer is calculated on the basis of the anticipated number of guests, the formulas chosen, the venue, and the requested services. Any change will automatically result in a price revision. Each updated offer replaces the previous one. POP POT SRL reserves the right to modify prices from one offer to another. 

6. Confirmation and 50% deposit

By signing the offer, the client acknowledges having read and accepted these general terms and conditions. POP POT SRL shall only be considered contractually bound upon receipt of the signed offer. When applicable, a deposit of 50% of the total amount of the offer will be requested prior to the event.

7. Number of guests and special diets

The final number of guests and any special dietary requirements (allergies, intolerances, etc.) must be confirmed by the client no later than five (5) working days before the event.

If the client requests a change in the number of guests less than five (5) days before the event, POP POT SRL reserves the right to accept or refuse such change. This clause is essential for POP POT SRL in order to optimise its services and avoid food waste. 

8. Cancellation

Any cancellation must be communicated to POP POT SRL by email at info@pop-pot.com at least seven (7) calendar days before the event.

In the event of cancellation received less than five (5) calendar days before the event, POP POT SRL will charge 50% of the service amount as compensation (excluding equipment, waitering, delivery, and set-up fees).

In the event of cancellation the day before the event, POP POT SRL reserves the right to charge the full amount of the offer.

9. Invoice

The final invoice will be calculated based on actual costs, taking into account the final number of guests, confirmed options, actual equipment rental and waitering hours, as well as any lost or damaged equipment fees. POP POT SRL does not accommodate requests to split invoices. 

10. Payment terms

Invoices are payable within fifteen (15) calendar days, unless another payment term is specified on the invoice or order. In the event of non-payment by the due date, POP POT SRL reserves the right to apply a fixed late-payment interest of 10% of the outstanding amount. POP POT SRL may suspend the provision of services without prior notice in the event of late payment.

If payment remains outstanding more than ninety (90) days after the due date, POP POT SRL reserves the right to engage a debt recovery company. All related legal and recovery costs shall be borne by the client.

11. Venue

The reservation of the venue, the signing of the rental agreement, and the payment of any deposit and rental fees are the sole responsibility of the client. POP POT SRL may charge an additional fee for venue research and coordination with the venue’s team. This fee does not include organisational difficulties encountered on-site during the event and may be communicated to the client and adjusted according to circumstances. 

12. Delivery fee

Delivery may be charged depending on the service, distance and parking accessibility. The client should communicate to POP POT SRL available parking places or garage, internal lifts to limit extra fees and optimize delivery.

13. Corkage fee

Due to specific conditions imposed by certain venues, a corkage fee may apply and be invoiced to the client in accordance with the venue’s rental contract.

14. Service

Where the order includes the provision of service staff, the client expressly authorises POP POT SRL to engage any waiters or additional staff required to fulfil the services stipulated in the offer, under a service supply contract. The client acknowledges and accepts these conditions. The client further agrees that POP POT SRL cannot be held liable for any issues arising within the scope of this mandate and undertakes to indemnify POP POT SRL against any claims brought by such staff members. 

15. Rented equipment

Where needed by the client, POP POT SRL may rent equipment such as tables, benches, tableware, décor, lighting, etc. This service and its associated fees are specified in the offer. Equipment is delivered in perfect condition and in accordance with the final number of guests. 

16. Loss, damage and breakage

All rented equipment remains under the sole responsibility of the client, who shall be liable for any loss or damage of any kind, whether accidental or otherwise. Any damage, particularly to table linens (burns, stains, etc.) or equipment, will be invoiced to the client. Fees for lost or damaged equipment will be calculated based on replacement value. 

17. Equipment conformity

The client or the venue chosen by the client must ensure that access to the premises, electrical supply, air-conditioning installations, and all connections comply with the technical requirements and standards of the equipment used. 

18. Liability

The client expressly and irrevocably releases POP POT SRL from any liability in the event of an accident at the venue, as well as from any damage caused by guests. The client shall be responsible for any theft, damage, or destruction of equipment rented from POP POT SRL.

POP POT SRL declines all liability for delays, interruptions, or delivery issues caused by difficult access to the premises, insufficient preparation of the venue, force majeure, or circumstances beyond its control (including strikes, adverse weather conditions, traffic accidents, or serious personal issues).

POP POT SRL also disclaims any liability for damage to clients or guests resulting from serious allergies or intolerances that were not communicated by email to info@pop-pot.com at least five (5) working days before the event. 

19. Competent court and applicable law

The Justice of the Peace of the 1st Canton of Brussels, the Court of First Instance of Brussels, or the Commercial Court of Brussels shall have exclusive jurisdiction over any dispute relating to the interpretation or execution of contracts concluded with POP POT SRL. Belgian law shall apply.
